The Brixton at 701 2nd St. first opened in the spring of 2019, the second location of the popular Marina District restaurant. But according to the lawsuit filed by the police union, the new restaurant was already falling behind on rent by late 2019. The lawsuit names the defendant as H2A Entertainment LLC, a company affiliated with Hat Trick Hospitality, the restaurant group behind the Brixton owned by Adam Snyder, Andy Wasserman and Hugo Gamboa.

“Base rent was not received in the five months leading up to the government shut down in March 2020,” reads the suit. 

From March 2020 to September 2021, the Brixton continued to not pay rent as permitted by a commercial eviction moratorium adopted by the San Francisco Board of Supervisors for businesses with 10 or fewer full-time employees, according to the suit. The deadline for repayment of deferred rent during the moratorium was Sept. 30, 2023.

“Defendant took advantage of the situation, making no attempt to pay down the deferred rent. September 30, 2023 came and went,” reads the suit. 

The SFPOA is now seeking to evict the Brixton from the space as well as $376,611.60 in unpaid rent (plus additional late fees, interest and attorney’s fees). Both the SFPOA and Hat Trick Hospitality declined to comment on the lawsuit to SFGATE. SFGATE did not hear back from the SFPOA’s attorneys in time for publication.
